1. About Brush

Brush is a mobile application that lets you make predictions on the outcomes of publicly reported events — currently focused on soccer/football tournaments, transfers, and related news. You browse prediction cards with a swipe interface, make predictions using virtual points, build streaks, appear on leaderboards, and (with a Brush Pro subscription) access AI-generated insights.

Market outcomes and reference prices are informational and are derived from third-party sources such as Polymarket. Brush is an independent product and is not affiliated with, endorsed by, or sponsored by Polymarket, any sports league, club, or governing body.

2. Eligibility & accounts

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use Brush. By using Brush you represent that you meet this requirement and that the information you provide during registration is accurate.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@brush.win if you suspect unauthorized use of your account. One person may not maintain more than one account, and accounts are personal to you and may not be transferred or sold.

You may delete your account at any time from within the app or at app.brush.win/delete-account.html.

3. License to use the app

Subject to your compliance with this Agreement, Indise LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the Brush app on Apple-branded devices that you own or control, solely for your personal, non-commercial use, and as permitted by the App Store Terms of Service and Usage Rules.

You may not, and may not permit anyone else to: (a) copy, modify, or create derivative works of the app; (b) reverse engineer, decompile, or disassemble the app except to the extent permitted by law; (c) rent, lease, lend, sell, redistribute, or sublicense the app; (d) remove or alter any proprietary notices; or (e) use the app in any way not expressly permitted by this Agreement.

4. Virtual points & predictions

Predictions in Brush use virtual points only. Virtual points are a licensed, non-transferable feature of the service. They:

• have no monetary or cash value and can never be redeemed for money, goods, or anything of value outside the app;
• are not your property and are not stored value, a bank account, or a financial instrument;
• cannot be bought with real money, transferred to other users, or withdrawn; and
• may be adjusted, expired, or reset by us, for example to run the game, fix errors, or address abuse.

Because no real money is wagered and no prizes of value are awarded, Brush is a game of entertainment and is not gambling. Predictions, leaderboard standings, streaks, and AI insights are provided for entertainment and informational purposes only and are not financial, investment, or betting advice. Outcomes are determined by reference to third-party data and may be delayed, corrected, or unavailable.

5. Brush Pro subscription

Brush offers an optional auto-renewable subscription, Brush Pro, that unlocks premium features such as AI market insights. The following terms apply to subscriptions purchased through the Apple App Store:

• Billing. Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewal. The subscription automatically renews for the same period (for example, monthly or yearly) unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Managing & canceling. You can manage and cancel your subscription in your device’s Settings > Apple ID > Subscriptions after purchase. Canceling stops future renewals; the current paid period continues until it ends.
• Pricing. Current prices and subscription options are shown in the app before purchase. We may change subscription prices; changes apply to future billing periods and, where required, will be communicated in advance.
• Refunds. Purchases are processed by Apple, and refunds are handled by Apple in accordance with the App Store Terms of Service. Except where required by law, payments are non-refundable and unused portions of a subscription period are not refundable.

If premium features are temporarily unavailable due to maintenance or third-party outages, we will make reasonable efforts to restore them but do not guarantee uninterrupted availability.

6. Acceptable use

You agree not to:

• use Brush for any unlawful purpose or in violation of any applicable law or regulation;
• cheat, exploit bugs, use bots or automation, or otherwise manipulate points, streaks, leaderboards, or referrals;
• create multiple or fake accounts, or impersonate any person or entity;
• upload or transmit content that is unlawful, harassing, hateful, defamatory, or infringing;
• interfere with, disrupt, or attempt to gain unauthorized access to the app, our servers, or other users’ accounts;
• scrape, harvest, or resell data from the service; or
• use the service in any way that could damage, disable, or overburden it.

Any username, display name, or profile content you provide must not be offensive, misleading, or infringing. We may remove content or names that violate these rules.

7. Ownership & intellectual property

Brush, including its software, design, logos, and content, is owned by Indise LLC and its licensors and is protected by intellectual property laws. Except for the limited license granted above, this Agreement does not transfer any right, title, or interest in the app to you. “Brush” and related marks are trademarks of Indise LLC. All rights not expressly granted are reserved.

8. Third-party services & data

Brush relies on third-party services and data providers, including Apple (distribution and payments), cloud infrastructure providers, analytics and notification providers, and market data sources such as Polymarket. Your use of the app may be subject to those third parties’ terms. We do not control and are not responsible for third-party services, and the accuracy, timeliness, or availability of third-party data is not guaranteed.

9. Privacy

We collect and process personal data — such as your email, username, date of birth, approximate location, and prediction activity — to operate and improve Brush. Our handling of your data is described in our Privacy Policy. By using Brush, you consent to that collection and use. You can contact us at support@brush.win with any privacy questions or requests.

10. Suspension & termination

We may suspend or terminate your access to Brush, or any part of it, at any time if you violate this Agreement, engage in fraud or abuse, or if we discontinue the service. You may stop using Brush and delete your account at any time. Upon termination, the license granted to you ends and you must stop using the app. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

11. Disclaimers

To the maximum extent permitted by law, Brush is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that predictions, data, insights, or outcomes will be accurate or reliable. Any material accessed through the app is used at your own discretion and risk.

12. Limitation of liability

To the maximum extent permitted by law, Indise LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of or inability to use Brush. Our total liability for all claims relating to the app will not exceed the greater of the amount you paid us for Brush Pro in the twelve (12) months before the claim, or fifty U.S. dollars (US$50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Indise LLC and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of Brush, your violation of this Agreement, or your violation of any rights of a third party.

14. Changes to this Agreement

We may update this Agreement from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of Brush after changes take effect constitutes acceptance of the updated Agreement. If you do not agree to the changes, stop using Brush and delete your account.

15. Governing law

This Agreement is governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to this Agreement or Brush will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, except where prohibited by applicable law.

16. Apple App Store additional terms

The following additional terms apply to your use of the Brush app obtained through the Apple App Store (the “Licensed Application”). In these terms, “Developer” means Indise LLC.

Acknowledgement

This Agreement is between you and the Developer only, and not with Apple. The Developer, not Apple, is solely responsible for the Licensed Application and its content. This Agreement does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions; in case of conflict, the Apple Usage Rules prevail.

Scope of license

The license granted to you for the Licensed Application is limited to a non-transferable license to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.

Maintenance and support

The Developer is solely responsible for providing any maintenance and support services for the Licensed Application, as specified in this Agreement or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services.

Warranty

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.

Product claims

The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual property rights

In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party’s intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Legal compliance

You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party terms of agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application.

Third-party beneficiary

You and the Developer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of its terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
